Alchemy Vibrations, LLC (Alchemy Visions)

These Terms of Service ("Terms") govern your access to and use of the Alchemy Visions mobile application and related services (including any web player link) (collectively, the "Services") provided by Alchemy Vibrations, LLC ("Alchemy Vibrations," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Eligibility
The Services are not directed to children under 13. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian.
2) Wellness Disclaimer; Not Medical Advice; Emergency Use
Alchemy Visions provides guided audio experiences intended to support reflection and general wellbeing. The Services do not provide medical advice, mental health treatment, diagnosis, or therapy, and are not a substitute for professional advice.
If you have a medical or mental health concern, seek the guidance of a qualified professional. The Services are not intended for emergency use. If you believe you may be in immediate danger or experiencing an emergency, contact local emergency services immediately. If you are in the United States and need immediate help, you can call or text 988 (the Suicide & Crisis Lifeline).
No guaranteed outcomes. Individual experiences vary. We do not guarantee that using the Services will produce any particular outcome (including clarity, relief, or transformation).
Safety warnings. Do not use the Services in situations where listening could create a risk to you or others, such as while driving, operating machinery, or performing safety-critical activities.
3) Account Required; Your Responsibilities
Account required. An account is required to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and to keep your account information up to date.
4) Content Access and Visibility
You can access: (i) content you create, (ii) limited demo content provided by us, and (iii) content shared with you by another user.
Default visibility. By default, your generated content is private and visible only to you unless you choose to share it or make it public.
5) Sharing Features; Public Visions; Web Player Links
A. Sharing options
The Services may allow you to share a vision in one or more ways, including:
- making a vision public,
- sharing with specific users, and/or
- generating a shareable web link.
B. Public share links (no account required)
Anyone with a share link may be able to access and listen to the shared vision without creating an account. Please share links only with people you intend to have access. We are not responsible if a share link is forwarded, reposted, or accessed by unintended recipients.
C. Public visions; prompt visibility; reuse
If you choose to make a vision "Public" or share it in a way that allows discovery by others, you understand and agree that other users may:
- discover and play the vision,
- save the vision within the App for offline playback,
- share the vision with others using a web player link,
- view the prompt used to create the vision, and
- reuse that prompt to generate new visions.
D. Deletion and downstream use (unlist model)
If another user generates a new vision from a public prompt, that new vision may be private and controlled by that user.
If you delete a public vision or delete your account, we will remove that vision from public discovery within the Services (for example, it will no longer appear as public content to other users). However, deletion may not remove:
- copies previously shared via a web player link,
- copies previously saved for offline playback,
- or visions created by other users based on reuse of the prompt prior to deletion.
To the extent permitted by law, deleting your content does not revoke rights already granted to others under these Terms.
E. In-platform access only
You may access and share visions only through the features we provide as part of the Services (including the web player). You may not download, extract, record, reproduce, redistribute, or otherwise make visions available outside the Alchemy Visions platform except as expressly permitted by these Terms.
6) Usage Limits; Rate Limiting
Your plan may include limits on usage (for example, per day, week, month, or year). We may enforce limits through rate limiting or other controls.
If you reach a limit, additional usage may be unavailable or may be offered for an additional fee or credits depending on availability. Usage limits, overage availability, and plan features may change over time.
7) Generation Times; Service Availability
We do not guarantee generation or delivery times for visions. Processing times may vary based on demand, service availability, and other factors.
The Services may be interrupted, delayed, or unavailable from time to time, including due to maintenance, outages, or third-party service interruptions.
8) User Content Rules; Filtering; Sensitive Information
You are responsible for the content you submit ("User Content").
You agree not to submit User Content that:
- violates applicable law,
- infringes another person's rights,
- involves exploitation of minors,
- includes instructions for wrongdoing or self-harm,
- is harassing, hateful, or abusive, or
- is otherwise prohibited by these Terms.
We may use automated and/or manual measures to restrict or filter content. We may block, remove, refuse to process, or limit distribution of content that violates these Terms or applicable law. We do not guarantee that filtering will catch all prohibited content.
Sensitive information. Please do not include sensitive personal information in prompts unless you are comfortable with it being processed and stored to provide the Services. You are responsible for the information you choose to submit.
9) Ownership; Licenses; Generated Content
A. Your prompts and User Content
As between you and Alchemy Vibrations, you retain ownership of your User Content (such as prompt text) to the extent you have ownership rights under applicable law.
B. License you grant to Alchemy Vibrations (to operate the Services)
You grant Alchemy Vibrations a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, process, and display your User Content as necessary to provide, maintain, and improve the Services (including generating visions, storing your history, and enabling sharing features).
C. Additional license when you make content public
If you make a vision public (including its prompt), you grant Alchemy Vibrations and other users a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute (via the Services and web player links), and reuse the prompt and the public vision within the Services, including to allow others to reuse the prompt to generate new visions.
D. Generated content; our rights; your limited permission
Visions may include text, narration, sound design, and background music owned by Alchemy Vibrations or licensed to us. You do not acquire ownership of those materials.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access, play, save for offline playback within the App, and share visions through the Services for personal, non-commercial use. You may not download, extract, copy, or redistribute visions outside the Services.
10) Payments, Subscriptions, Trials, and Credits
A. Subscriptions and credits
Some features may require a paid subscription. We may also offer credits that can be used with or without a subscription. Credits may be offered for purchase or granted as part of a plan or promotion. Credits have no cash value and are non-transferable except where required by law.
B. Free trials and promotions
We may offer free trials to some or all users from time to time. Trial availability and duration may vary based on context, including promotions. Unless otherwise disclosed, after a trial ends, your paid subscription may begin and renew automatically until you cancel.
C. Additional usage after limits
If you reach plan limits, you may or may not be offered the option to purchase additional usage or credits depending on availability and operational constraints.
D. Apple in-app purchases
If you purchase a subscription or other paid features through Apple's in-app purchase system, Apple processes the payment and manages billing. Your purchase may be subject to Apple's terms and policies.
E. Stripe (web only)
We may offer purchases on our website processed by Stripe ("Stripe Purchases"). Stripe Purchases are subject to these Terms and Stripe's terms. We do not store full payment card numbers; Stripe handles payment processing.
Note: Purchases of digital content or features inside the iOS App may be required to use Apple's in-app purchase system. Our purchase options may change over time to comply with platform rules.
11) Refunds and Cancellations
A. Apple purchases
For purchases made through Apple's in-app purchase system, refunds are handled by Apple, and we cannot guarantee refunds for those purchases. You should request refunds through Apple's support channels.
B. Stripe purchases
For Stripe Purchases, refunds are provided at our discretion unless required by law. In general, if you have listened to more than one (1) vision after a Stripe Purchase, we may decline a refund. If you believe you have an issue with a Stripe Purchase, contact us at daren@alchemyvisions.ai.
12) Service Improvement
We may use information and content to operate, maintain, and improve the Services, consistent with our Privacy Policy.
13) Third-Party Services
The Services may rely on third-party services (for example, AI model providers, hosting, analytics, or payment processors). We are not responsible for third-party services beyond what is required by applicable law, and your use of those services may be subject to third-party terms and policies.
14) Termination; Suspension; Appeals
We may suspend or terminate your access to the Services, remove content, or restrict sharing in our sole discretion, including if:
- you violate these Terms,
- your use creates risk or legal exposure for us or others,
- we suspect fraud, abuse, or illegal activity,
- we are required to do so by law, or
- we discontinue the Services.
You may stop using the Services at any time. You may delete your account in the App settings.

15) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
16) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALCHEMY VIBRATIONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
(Some jurisdictions do not allow certain limitations; in those jurisdictions, these limits apply to the extent permitted by law.)
17) Indemnification
You agree to indemnify and hold harmless Alchemy Vibrations from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content, (b) your use of the Services, or (c) your violation of these Terms.
18) Governing Law; Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
Except where prohibited by law, you agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
19) Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date and, if changes are material, provide additional notice within the Services or by other means.
20) Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Services, you agree that we can collect and use information as described in the Privacy Policy.
